1. Acceptance of Terms

By downloading, installing, or using Profit Prophet ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms apply to the mobile application, the website at profitprophet.co.uk, and all associated services.

2. Description of Service

Profit Prophet is an AI-powered reselling assistant that provides product identification, pricing analysis, eBay listing generation, inventory management, local sourcing information, and community features. The App uses artificial intelligence and third-party data sources (including eBay and Google) to provide estimates and suggestions. These are informational only and should not be treated as financial advice.

3. Account Registration

You must create an account to use Profit Prophet. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate information when creating your account. You must be at least 13 years old to use the App. Users under 18 must have parental or guardian consent.

4. Subscriptions and Payments

• Free Tier: Limited daily scans, listings, and inventory slots as described in the App.
• Pro Lite and Pro: Paid subscription plans with expanded or unlimited features.
• Subscriptions are managed through the Apple App Store or Google Play Store. Payment is charged to your store account.
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.
• You can cancel your subscription at any time through your App Store or Play Store settings.
• Refunds are handled by Apple or Google according to their respective refund policies.
• We reserve the right to change subscription pricing with reasonable notice.

5. Hive Mind Community

The Hive Mind is an optional community feature. By opting in, you agree to share anonymised scan data (item names and prices) with other users to improve pricing accuracy. You can opt out at any time in Settings. Points earned through the Hive Mind can be used to unlock cosmetic items and Pro trial passes within the App. Points have no monetary value and cannot be exchanged for cash.

6. Ambassador Programme

Ambassadors receive a referral code and earn a percentage of subscription revenue from referred users. Revenue share terms are set at the time of code creation and may be reviewed after 12 months. We reserve the right to suspend or terminate referral codes for abuse, fraud, or violation of these Terms. Referral earnings are paid according to the schedule agreed upon joining the programme.

7. Acceptable Use

You agree not to:

• Use the App for any illegal purpose or in violation of any laws
• Attempt to reverse engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's servers or networks
• Create multiple accounts to circumvent usage limits
• Scrape, harvest, or collect data from the App by automated means
• Submit false, misleading, or fraudulent information
• Use the App to harass, abuse, or harm other users
• Resell or redistribute access to the App

8. Intellectual Property

The App, including its design, code, features, and content, is owned by Profit Prophet and protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the App for personal and commercial reselling purposes. You may not copy, modify, distribute, or create derivative works based on the App.

9. AI-Generated Content

The App uses artificial intelligence to identify products, estimate prices, generate listings, and provide recommendations. AI-generated content is provided "as is" and may contain errors or inaccuracies. You are responsible for reviewing and verifying all AI-generated content before use. We do not guarantee the accuracy of price estimates, product identifications, or listing descriptions. Market values fluctuate and past sold prices do not guarantee future selling prices.

10. Third-Party Services

The App integrates with third-party services including eBay, Google, and others. Your use of these services through the App is subject to their respective terms of service. We are not responsible for the availability, accuracy, or conduct of third-party services. eBay listings created through the App are subject to eBay's terms and policies.

11. Local Sourcing Information

Local sourcing results (shops, events, car boot sales, etc.) are discovered using AI and may not always be accurate or up to date. We do not guarantee that listed events will take place or that listed shops are still operating. Always verify event details before travelling. User-submitted events are not verified by us.

12. Limitation of Liability

To the maximum extent permitted by law, Profit Prophet and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the App. Our total liability for any claim shall not exceed the amount you paid for the App in the 12 months preceding the claim.

13. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy or completeness of any information provided through the App.

14. Termination

We may suspend or terminate your account at any time for violation of these Terms, with or without notice. Upon termination, your right to use the App ceases immediately. You may delete your account at any time through the App's Settings or by emailing us.

15. Changes to Terms

We may update these Terms from time to time. Significant changes will be communicated through the App. Continued use of the App after changes constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

17. Apple-Specific Terms

If you downloaded the App from the Apple App Store: these Terms are between you and Profit Prophet, not Apple. Apple has no obligation to provide maintenance or support. Apple is not responsible for any product claims, intellectual property claims, or failure to conform to any warranty. Apple and its subsidiaries are third-party beneficiaries of these Terms.
